Terms of service

Last updated: 28 September 2026

Hello, and thank you for shopping with Winston's Emporium. These are the rules for buying from our shop. We have written them to be read, not skimmed, so they are as plain as we could make them. Nothing here takes away the rights you have as a consumer under UK law. If anything is unclear, email us at winstonsemporium@outlook.com and a human (not a corgi) will reply.

1. Who we are

Winston's Emporium is the trading name of Arthur Lawlor, a sole trader. Our address is Hen Ysgubor, Coed Pryfydey, Llanbrynmair, Powys, Wales, SY19 7DN. You can reach us at winstonsemporium@outlook.com. Our VAT position is explained in section 5.

In these terms, "we", "us" and "our" mean Winston's Emporium. "You" means the person placing the order.

2. What these terms cover

These terms apply to every order you place with us through winstonsemporium.co.uk (or winstonsemporium.com, which points to the same shop) as a consumer, that is, buying for yourself and not for a business.

Some of what we offer has its own terms, which sit alongside these:

  • VIP Membership Terms, for the Discord alert membership.
  • Wholesale Terms, for business customers.
  • Card Request Terms, for our card sourcing service.
  • Returns and Refunds Policy and Shipping Policy, which explain in plain words how the rules in sections 7 to 10 work in practice.

If a specific set of terms says something different from these terms for that service, the specific terms win for that service only.

We may update these terms from time to time. The version shown on the site when you place your order is the one that applies to that order.

3. Who can buy

  • You must be 18 or older to place an order. If you are under 18, a parent or guardian must place the order for you. They become the customer and these terms apply to them.
  • We may cancel and refund any order we reasonably believe was placed by someone under 18 without a parent's or guardian's permission.
  • We deliver to UK addresses only. Orders with a delivery address outside the UK will be cancelled and refunded in full.
  • If you are buying for a business, please use our wholesale service. The Wholesale Terms apply to business purchases, and consumer cancellation rights do not.

4. Ordering, and when a contract is formed

Placing an order works like this:

  1. You add products to your basket and go to checkout.
  2. You enter your details, delivery address and payment method. Before you pay, the checkout shows you the full order, including delivery costs, and lets you go back and correct anything.
  3. You confirm the order and pay.

When we receive your order we send you an order confirmation email. This email means we have received your order and taken payment. It is not yet our acceptance of your order.

We accept your order, and a contract between us is formed, when we send you a dispatch confirmation email telling you the goods are on their way. For pre-orders, this happens when the pre-order item is dispatched.

Until we send the dispatch confirmation, we may decline your order. We may do this if, for example:

  • the product is out of stock or our supplier has cut our allocation;
  • the price or description on the site was clearly wrong;
  • we cannot verify your payment or the order is flagged by fraud checks;
  • the delivery address is outside the UK;
  • the order breaks a purchase limit we have set on a product (see below); or
  • we reasonably believe the order was placed by an automated tool or through several accounts to get around a limit.

If we decline an order after you have paid, we tell you by email and refund you in full, promptly and in any event within 14 days.

Purchase limits: on high-demand products we may limit how many each customer can buy. The limit is shown on the product page. We may cancel and refund orders that go beyond it.

5. Prices and VAT

  • All prices are in pounds sterling.
  • The price that applies is the one shown on the site when you place your order.
  • Delivery costs are shown at checkout before you pay. The total at checkout is the full price you pay. Nothing is added afterwards.
  • Prices include VAT where we are required to charge it. If we are registered for VAT, our VAT number is shown in the site footer and on your order documents, and prices on the site include VAT at the current UK rate. If we are not registered for VAT, no VAT is charged and none is shown.
  • We check prices carefully, but mistakes happen. If a product was listed at a price that is obviously wrong and you could reasonably have been expected to notice, we may cancel the order before dispatch. We will contact you first, and if we cancel we refund you in full.

6. Payment

  • You pay in full when you place your order, including for pre-orders.
  • We accept the payment methods shown at checkout, currently debit and credit cards, Apple Pay, Google Pay and Shop Pay.
  • Payments are processed by our payment providers. We never see or store your full card number.
  • Orders may go through automated fraud checks run by our payment providers. If a check fails we may ask you for more information or decline the order.

7. Delivery

  • We deliver to UK addresses only. Details of carriers, dispatch times and costs are in our Shipping Policy.
  • Dispatch and delivery times shown on the site are estimates, unless a page clearly states a fixed delivery date that we have agreed with you.
  • If we have not delivered your goods within 30 days of your order (or by a later date we agreed with you), you may cancel the order and we will refund you in full. If a specific delivery date was essential and we miss it, you may cancel straight away.
  • The goods become your responsibility when they are delivered to the address you gave us, or to a person you nominate to receive them.
  • If you give us a wrong or incomplete address, we may ask you to pay the cost of redelivery.
  • If a parcel arrives damaged, please tell us as soon as you can and keep the packaging. Section 10 explains what we do about it.

8. Pre-orders

Some products are offered before we have them in stock. You will know a product is a pre-order because its title starts with "PRE-ORDER:".

  • The product page shows the date by which we dispatch. We set it with a margin over the date our supplier has given us, so most pre-orders go out earlier.
  • You pay in full at checkout. The price you pay is fixed, even if the product's price changes before dispatch.
  • We only list the quantity our supplier has confirmed to us, and we do not sell beyond it.
  • If that date slips, we email you as soon as we know. You can choose to keep waiting or to cancel for a full refund. We repeat this offer if the date slips again.
  • If our supplier cuts or cancels our allocation, we tell you and refund you in full.
  • On top of your legal cancellation rights in section 9, you may cancel a pre-order for any reason at any time before it is dispatched, for a full refund.
  • If you order a pre-order item and in-stock items together, see the Shipping Policy for how and when the order ships.

9. Your right to change your mind

As a consumer buying at a distance, you have a legal right to cancel your order and return the goods, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You do not need to give a reason.

How long you have. You may cancel at any time from the moment you place the order until 14 days after the day you (or someone you nominate) receive the goods. If your order is delivered in several parcels, the 14 days run from the day you receive the last one.

How to cancel. Tell us clearly that you want to cancel. Email winstonsemporium@outlook.com, or use the cancellation form at the end of these terms (you do not have to use the form). Cancelling in time is what matters, so please send your message before the 14 days are up.

Sending the goods back. Send the goods back to Hen Ysgubor, Coed Pryfydey, Llanbrynmair, Powys, Wales, SY19 7DN within 14 days of telling us you are cancelling. You are responsible for the cost of returning goods when you change your mind, and for the goods until they reach us, so we recommend a tracked service and keeping your proof of posting. We do not refund return postage for change-of-mind returns.

Your refund. We refund the price you paid for the goods plus the standard delivery charge (if you chose a faster or more expensive delivery option, we refund only the cost of our cheapest standard option). We refund within 14 days of receiving the goods back, or of you sending us proof that you have posted them, whichever is earlier. We refund to the payment method you used.

Opened or handled goods. The legal exceptions to the cancellation right (for example for hygiene-sealed goods or unsealed software) do not apply to sealed trading card product, and we do not rely on them. You can cancel even if you have opened the product. What the law does allow us to do is to deduct for any loss in value caused by handling that goes beyond what you would need to do to check the goods in a shop.

In a shop you would look at the box, read the label and check for damage. Going further, for example removing the factory shrink-wrap, opening the box, opening booster packs or removing the contents, reduces what the goods are worth. A booster box with its factory seal broken sells for much less than a sealed one. Opened packs have very little resale value. Where that happens we may deduct an amount that reflects the loss in value, up to the full price paid. We tell you the deduction and how we worked it out before we refund. The Returns and Refunds Policy has worked examples.

Services and memberships. This section is about goods. Your rights to cancel a VIP membership or a card request are set out in the VIP Membership Terms and the Card Request Terms.

10. Faulty, damaged or wrong goods

Under the Consumer Rights Act 2015, goods we sell must match their description, be of satisfactory quality and be fit for purpose. Nothing in these terms affects those rights.

What we promise about sealed product:

  • It is genuine product from the official manufacturer or its licensed distributor.
  • It is factory sealed, unless the product page clearly says otherwise.
  • It is the language edition and set named in the product title.
  • It arrives with its seal intact and its packaging in the condition a collector would reasonably expect. Minor marks to outer packaging can happen in the manufacturer's supply chain, but a broken seal, a crushed or torn box or significant packaging damage is a fault, and we put it right.

What we cannot promise: the contents of any sealed pack or box. Pull rates, the presence of particular cards and the resale value of what you open are outside our control and are not a quality issue.

If goods arrive faulty, damaged or not as described:

  • Within 30 days of delivery, you may reject them for a full refund, or ask for a replacement. Since sealed product cannot be repaired, replacement is the usual remedy, subject to stock.
  • After 30 days and up to six months, you may ask for a replacement, and if we cannot provide one, a refund.
  • We pay the cost of returning faulty, damaged or wrong goods. We will tell you how to send them back, or arrange collection.
  • Please tell us as soon as you notice a problem. Photos of the goods and packaging help us sort it out quickly and make any claim with the carrier.

If we send you the wrong item, we pay to get it back and send you the right one, or refund you if you prefer.

11. Product descriptions and market value

  • Language editions differ. Simplified Chinese product is made for the Chinese market: card text is in Chinese, and set contents and numbering may differ from English releases. Cards from one language edition may not be allowed in official tournament play in another region. Check the rules of your event before buying for play.
  • Product images are representative. Manufacturers sometimes change packaging between print runs.
  • Collectible prices go up and down. We are not responsible for changes in the market value of anything you buy from us after you buy it.

12. Our responsibility to you

We do not exclude or limit our responsibility for: death or personal injury caused by our negligence; fraud; your rights under the Consumer Rights Act 2015; or defective products under the Consumer Protection Act 1987.

Otherwise:

  • We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill.
  • We are not responsible for business losses. If you use our goods for a business, the Wholesale Terms apply instead.
  • We are not responsible for lost resale profit or for changes in market value.
  • Our total responsibility for any order is limited to the price you paid for that order, except in the cases listed above where the law does not allow a limit.

If something outside our reasonable control (for example a carrier strike, severe weather or a supplier failure) delays an order, we tell you as soon as we can. If the delay is substantial you may cancel and we refund you in full.

13. Promotions and drops

  • Promotions and discount codes are subject to availability and may be ended early. Unless stated otherwise, one code per order.
  • Early access to drops is a perk for opted-in customers and members. It does not guarantee stock.
  • We may cancel and refund orders placed using automated tools or multiple accounts to get around purchase limits or early-access rules.

14. Your account

Accounts are optional. If you create one, keep your login details safe and tell us if you think someone else has used it. We may close an account that is used to break these terms.

15. Complaints

If something has gone wrong, email winstonsemporium@outlook.com with your order number. We aim to reply within 2 working days. We will do our best to fix things. If you are not satisfied, you can contact the Citizens Advice consumer service for free advice, or bring a claim in court (see section 17). We are not currently signed up to an alternative dispute resolution scheme.

16. Other things

  • Your personal data is handled as set out in our Privacy Policy.
  • We may transfer our rights and obligations under these terms to another business, and will tell you if we do. Your rights are not affected.
  • Nobody other than you and us has any rights under these terms.
  • If a court finds part of these terms unenforceable, the rest still applies.
  • If we do not insist on a right straight away, we can still insist on it later.

17. Law and courts

These terms are governed by the law of England and Wales. You can bring court proceedings in the courts of England and Wales. If you live in Scotland you can also bring proceedings in Scotland, and if you live in Northern Ireland you can also bring proceedings in Northern Ireland.
